NO PURCHASE NECESSARY.

OPEN TO: A) LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 19 YEARS OF AGE AND OLDER AND WHO ARE PHYSICALLY LOCATED AND RESIDE IN THE UNITED STATES OR DISTRICT OF COLUMBIA; AND B) LEGAL RESIDENTS OF CANADA (EXCLUDING THE PROVINCE OF QUEBEC) WHO ARE 19 YEARS OF AGE AND OLDER AND WHO ARE PHYSICALLY LOCATED & RESIDE IN CANADA (EXCLUDING THE PROVINCE OF QUEBEC).

2. ELIGIBILITY: RedLaser (eBay) Death Cab for Cutie Sweepstakes (the “Sweepstakes”) is open to: a) legal residents of the states of the fifty (50) United States and the District of Columbia who are 19 years of age and older and who are physically located and reside in the United States or District of Columbia at time of entry; AND b) legal residents of Canada (excluding the Province of Quebec) who are 19 years of age and older and who are physically located and reside in Canada (excluding the Province of Quebec) at the time of entry ("Eligible Participants"). Void in Puerto Rico, the Province of Quebec and where prohibited. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and their respective household members, of eBay Inc. (“eBay”) and its affiliates, subsidiaries, and divisions (“eBay Entities”) (eBay and eBay Entities collectively, “Sponsor”), Atlantic Recording Corporation, Death Cab for Cutie, DCFC LLC, Six to Start, Sponsor’s advertising and promotion agencies, and Tenthwave Digital LLC are not eligible to enter. This Sweepstakes is subject to all federal, state, local, provincial and municipal laws. U.S. law governs this Sweepstakes and personal jurisdiction shall exclusively be the state and federal courts located in Santa Clara, California. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you understand that you are providing your information to the Sponsor and not to Facebook. The information you provide will only be used for administration of the Sweepstakes.

3. SWEEPSTAKES TIMING/DESCRIPTION: The Sweepstakes begins at 4:00 PM Eastern Time (ET) on May 11, 2011 and ends 11:59:59 PM ET on May 31, 2011 (the "Promotion Period"). There will be one (1) Grand Prize drawing at the end of the Promotion Period from among all eligible entries received during the Promotion Period; and there will be one (1) drawing conducted each week during the Promotion Period (“Weekly Drawings”) for a total of three (3) Weekly Drawings conducted from among all eligible entries received for each respective week during the Promotion Period.

4. HOW TO ENTER: There are two (2) ways to enter the Weekly Drawings: 1) By completing and submitting the online Registration Form and successfully playing the featured game; or 2) By Online Alternate Method of Entry. All eligible entries submitted for the Weekly Drawings will be automatically entered into the Grand Prize random drawing at the end of the Promotion Period.

Weekly Drawing Period #1: 5/11/11 – 5/17/11

1) Complete and submit the online Registration Form and successfully complete the featured game: To play “Line of Best Fit” and enter the Sweepstakes via this method, go to Fourcodesandkeys.com from 4:00:00 PM ET on 5/11/11 through 11:59:59 PM ET on 5/17/11 (“Week 1 Entry Period”) and complete and submit the Registration Form, including which venues you wish to be eligible to win from among the venues described for Week 1 in Rule #6 below. You may complete the Registration Form via Facebook Connect by clicking the Facebook Connect button that appears on the Registration Form. You will be asked to provide your Facebook User ID and password. To complete registration, select which venues you wish to be eligible to win on your profile page. Once you have completed and submitted the Registration Form, you will be presented with a board of empty squares and a random assortment of letters on a “shelf”, each with a point value assigned to them. You must try to arrange letters on the board to form words with the highest point values possible. Any letters placed on the board for a valid word will be replaced from a limited and hidden pool of letters, with this process continuing until the pool runs out. There will also be a QR code next to this board. The words in this code will be bonuses, and when played, they will add bonus points to your current score. If you can’t make any words with the letters you have on your shelf, you may withdraw your entire shelf of letters, up to three (3) times. If you place a valid word over a special tile, this will increase the size of your shelf by another space. When your pool of letters runs out, you must have accumulated at least 500 points during the Week 1 Entry Period in order to be eligible to be entered in the Weekly Drawing. If you have accumulated at least 500 points, click “End Game” to receive one (1) entry in the Sweepstakes. Entry must be received by 11:59:59 PM ET on May 17, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

2) Online Alternate Method of Entry: To enter the Sweepstakes without solving the puzzle, email your first and last name, email address, telephone number and which venues you wish to attend if you are selected as a winner to Fourcodesandkeys@tenthwave.com during the Week 1 Entry Period. Entry must be received by 11:59:59 PM ET on May 17, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

Weekly Drawing Period #2 – 5/18/11 – 5/24/11

1) Complete and submit the online Registration Form and successfully complete the featured game: To play “You Are a Tourist” and enter the Sweepstakes via this method, go to Fourcodesandkeys.com from 4:00:00 PM ET on 5/18/11 through 11:59:59 PM ET on 5/24/11 (Week 2 Entry Period) and complete and submit the Registration Form, including which venues you wish to be eligible to win from among the venues described for Week 2 in Rule #6 below. You may complete the Registration Form via Facebook Connect by clicking the Facebook Connect button that appears on the Registration Form. You will be asked to provide your Facebook User ID and password. To complete registration, select which venues you wish to be eligible to win on your profile page. Once you have completed and submitted the Registration Form, you are ready to play the “You are a Tourist” game, which takes place over two (2) stages. In the 1st stage, you must complete a series of challenges on Wanderlust, a free web-based mobile application (compatible with all smartphones). You will receive links to these challenges in the form of QR codes on the Four Codes and Keys websites. In each challenge, you will be given a riddle to decipher and must use Wanderlust on a mobile device or a laptop to physically visit the type of location (e.g. cafe, library) described in the riddle, and “check in” online to complete the challenge. All challenges must be completed by at least one player in order to unlock the second stage for all players. To participate in the 2nd stage, follow the directions that appear on fourcodesandkeys.com and successfully complete the 2nd puzzle once it has been unlocked. When you successfully complete the 2nd puzzle during the Week 2 Entry Period, you will be automatically entered in the Sweepstakes. Entry must be received by 11:59:59 PM ET on May 24, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

2) Online Alternate Method of Entry: To enter the Sweepstakes without solving the puzzle, email your first and last name, email address, telephone number and which venues you wish to attend if you are selected as a winner to Fourcodesandkeys@tenthwave.com during the Week 2 Entry Period. Entry must be received by 11:59:59 PM ET on May 24, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

Weekly Drawing Period #3 – 5/25/11 – 5/31/11

1) Complete and submit the online Registration Form and successfully complete the featured game: To play the game and enter the Sweepstakes via this method, go to Fourcodesandkeys.com from 4:00:00 PM ET on 5/25/11 through 11:59:59 PM ET on 5/31/11 (Week 3 Entry Period) and complete and submit the Registration Form, including which venues you wish to be eligible to win from among the venues described for Week 3 in Rule #6 below. You may complete the Registration Form via Facebook Connect by clicking the Facebook Connect button that appears on the Registration Form. You will be asked to provide your Facebook User ID and password. To complete registration, select which venues you wish to be eligible to win on your profile page. Once you have completed and submitted the Registration Form, you are ready to play the game. Each day during the Week 3 Entry Period, you will receive one or more missions via Twitter or email. To receive missions via Twitter, you must have or create a non-private Twitter account. If you already have a Twitter account, submit your email address and password and sign in. If you are not an existing member of Twitter, you will be required to follow the directions and join Twitter. When you join Twitter, you are indicating that you have read and agree to accept the Twitter Terms of Service and Privacy Policy. Membership to Twitter.com is free. These missions will require you to take photographs meeting mission-specific criteria (for example, a picture of a white cat) and send these pictures to the email address given along with the challenge. The photograph must meet the criteria of the mission in order to be eligible. Photograph must be in keeping with the Sponsor's image, and may not be offensive, nor can it defame, or invade upon the publicity rights or privacy of any person or otherwise infringe upon any person or entity's intellectual property, personal or proprietary rights, as determined by Sponsor in their sole discretion. By submitting a photograph, participant hereby: 1) grants to Sponsor the right to use participant's photograph for advertising, publicity and promotional purposes, in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification or permission; and 2) waives and agrees not to assert any moral rights in the photograph against Sponsor. Further, participant represents and warrants they own or have secured all rights necessary for the aforementioned uses of participant's photograph. Sponsor, in its sole discretion, will determine if a photograph is eligible. For each successfully completed mission, you will earn one hundred (100) points; plus each successfully completed mission will help to complete a photo mosaic of a QR code. When the photo mosaic is filled in, any player can scan the QR code to access a final mission worth an additional two hundred (200) points. When you have accumulated at least 500 points during the Week 3 Entry Period, you will be automatically entered in the Sweepstakes. Entry must be received by 11:59:59 PM ET on May 31, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

2) Online Alternate Method of Entry: To enter the Sweepstakes without playing the game, email your first and last name, email address, telephone number and which venues you wish to attend if you are selected as a winner to Fourcodesandkeys@tenthwave.com during the Week 3 Entry Period. Entry must be received by 11:59:59 PM ET on May 31, 2011 in order to be eligible. Limit one entry per person/email address. Subsequent entries submitted by the same person/email address will be void.

Entrants may enter only by using one of the entry methods described in these Official Rules. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Proof of emailing does not constitute proof of delivery. Entries that are mechanically reproduced, copied, illegible, incomplete, late or inaccurate are void. Sponsor is not responsible for late, lost, incomplete illegible, damaged or misdirected entries. Duplicate entries submitted by the same person/email address for each Weekly Entry Period are void. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Entries become the property of Sponsor and will not be acknowledged or returned. Sponsor’s decisions are final on all matters relating to this Sweepstakes. If a dispute results as to the identity of an entrant, it will be determined that the entry was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. The Sweepstakes Website’s database clock will be the official timekeeping device for the Sweepstakes.

5. DETERMINATION OF WINNERS: Week 1: Three (3) potential winners will be selected in a random drawing for Week 1 on or about 12:00:00 PM ET on or about May 18, 2011 from among all eligible entries received during the Week 1 Entry Period. Week 2: Three (3) potential winners will be selected in a random drawing for Week 2 on or about 12:00:00 PM ET on or about May 25, 2011 from among all eligible entries received during the Week 2 Entry Period. Week 3: Two (2) potential winners will be selected in a random drawing for Week 3 on or about 12:00 PM ET on or about June 1, 2011 from among all eligible entries received during the Week 3 Entry Period. Grand Prize: One (1) Grand Prize winner will be selected in a random drawing on or about 12:00:00 PM ET on or about June 2, 2011 from among all eligible entries received during the Promotion Period. The random drawings will be conducted by Tenthwave Digital LLC, an independent judging organization, in Melville, NY. Judges’/Sponsor’s decisions are final on matters relating to this Sweepstakes. Potential winners will be notified by electronic mail within twenty-four (24) hours of the random drawing. Potential winners may be required to verify their contact information within forty-eight (48) hours of notification prior to issuance of a prize. Non-compliance within this time frame, or if prize notification is returned as undeliverable, will result in the entrant being disqualified, and the prize may be awarded to a potential alternate winner. Winners will be instructed to pick up their prize at Will Call at the specified venues and show proper identification. Odds of winning a Weekly Prize depend upon the number of eligible entries received for that respective week; and odds of winning a Grand Prize depend upon the number of eligible entries received for the Promotion Period. Limit one prize per person/email address. As a condition for receiving any prize, winners who are residents of Canada will be required to correctly answer (unaided) a time-limited mathematical skill-test question.

6. PRIZES: Week 1: Three (3) Prizes: Two (2) tickets to see Death Cab for Cutie in concert in one of the following venues: Shaw at Edmonton, AB on 5/24/11; Stampede Corral at Calgary on 5/25/11; the Bowery in New York City on 6/1/11. Approximate Retail Value (ARV) $70.00/ea. USD. Week 2: Three (3) Prizes: Two (2) tickets to see Death Cab for Cutie in concert in one of the following venues: 9:30 Club in Washington DC on 6/3/11; Trocadero in Philadelphia on 6/4/11; Paradise in Boston on 6/5/11. ARV: $70.00/ea. USD. Week 3: Two (2) Prizes: Two (2) tickets to see Death Cab for Cutie in concert in one of the following venues: El Rey Theatre in Los Angeles on 6/7/11; Fillmore in San Francisco on 6/9/11. ARV: $70.00/ea. USD. Grand Prize: One (1) Grand Prize consisting of eleven (11) Death Cab for Cutie posters. ARV: $275.00 USD. Total ARV of all prizes: $835.00 USD. Local venues of concerts to be determined by Sponsor. If any part of any event is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, Sponsor will not be obligated to provide an alternative prize and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Tickets awarded as part of a prize are subject to the terms and conditions stated on such tickets as well as any venue terms and conditions.

Prizes do not include hotel accommodations or transportation to or from any venue. Winner is responsible for all hotel and transportation costs associated with a prize. All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winner. Prizes are not transferable and no substitutions or cash equivalents are permitted, except that Sponsor at its sole discretion, may substitute a prize with a prize of equal or greater value. Specifics of the prizes are in Sponsor’s sole discretion. All claimed prizes will be awarded.

7. CONDITIONS OF PARTICIPATION: By entering, entrants agree to be bound by these Official Rules including all eligibility requirements. Further, entrants will comply with all Twitter and Facebook terms and privacy policies. Sponsor’s use of information submitted by entrants in connection with this Sweepstakes will be subject to the terms and conditions stated in these Official Rules. Sponsor will collect information from the entrant solely for the purpose of administering the Sweepstakes and to notify the winners. Sponsor will not share this information with any third parties, except as necessary for the administration of the Sweepstakes. If participant has checked the box that appears on the Registration Form, participant agrees to receive future information from the Sponsor. All materials submitted in connection with the Sweepstakes become the property of Sponsor and will not be returned. By accepting a prize, winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material and entry submission for advertising, publicity and promotional purposes by Sponsor, or a party designated by Sponsor, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Entrants agree that the conditions of submission set forth in these Official Rules, and all documents and agreements incorporated in these Official Rules by reference, solely govern the relationship between entrants and Sponsor in connection with this Sweepstakes. Entrants agree to waive any right to claim ambiguity in these Official Rules. Entrants agree that any and all disputes shall be governed by the laws of the State of California and the United States of America.

ALL ELIGIBLE PARTICIPANTS ACKNOWLEDGE AND AGREE THAT ALL PHOTOGRAPHS SUBMITTED IN CONNECTION WITH THIS SWEEPSTAKES ARE SUBMITTED ON A NON-CONFIDENTIAL AND NON-PROPRIETARY BASIS AND MAY BE USED BY SPONSOR, ITS AGENTS AND SUBSIDIARIES, FOR ADVERTISING AND PROMOTIONAL PURPOSES INCLUDING (BUT NOT LIMITED TO) IN CONNECTION WITH THE SWEEPSTAKES.

8. LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS SPONSOR, ATLANTIC RECORDING CORPORATION, DEATH CAB FOR CUTIE, DCFC LLC, SIX TO START, FACEBOOK, INC. AND TENTHWAVE DIGITAL LLC, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, DIVISIONS, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES AND SHAREHOLDERS (COLLECTIVELY, THE “RELEASEES”) FROM ANY CLAIMS, ACTIONS, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES), INJURY, LOSS OR DAMAGES OF ANY KIND (COLLECTIVELY, “CLAIMS”), INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THE SWEEPSTAKES OR ANY CLAIMS ARISING FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS BROUGHT BY THIRD PARTIES. ELIGIBLE PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE SWEEPSTAKES OR THE PRIZE AWARDED. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, RELEASEES DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO ANY PROMOTIONAL WEB SITE AND RELEASEES SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME PROVINCES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Releasees are not responsible for lost, late, incomplete, illegible, inaccurate, delayed, garbled, damaged, stolen or misdirected entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, inability to submit an entry, or fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by Sponsor, users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit an Eligible Participant’s ability to participate in the Sweepstakes. Releasees are not responsible for late, lost, incomplete, illegible, damaged or misdirected entries. Entry materials that have been tampered with or altered are void. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of the Sweepstakes or modify these Official Rules at any time without notice, if in the judges’ opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if any virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Sweepstakes or for any other reason in its sole discretion. In such event, Sponsor may void any entries they suspect are at issue and award a prize from among all non-suspect eligible entries received up to the date of cancellation. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE SWEEPSTAKES WEBSITE OR ANY ONLINE SERVICE RELATED TO THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of such term or any other provision. Sponsor reserves the right to disqualify any entrant who violates these Official Rules or interferes with the Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate such entrant’s eligibility to participate in the Sweepstakes. Any attempt by an individual to access any website associated with the Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in that individual’s IP address and all entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited.

9. DISPUTES: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Eligible Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California and the United States of America, without giving effect to any choice of law or conflict of law rules (whether of the State of California, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

10. WINNERS’ LIST: For the names of the winners, available after June 30, 2011, mail a self-addressed, stamped envelope by June 30, 2011 to: eBay Death Cab for Cutie Sweepstakes Winners, P. O. Box 997, Plainview, NY 11803-0997. Residents of Canada may omit return postage.
